PER COURT :- 1) When the matter was taken up for hearing, both the learned Counsel appearing for the respective parties submit that in similar set of facts in the matter of Prakash s/o Chaitram Shinde Vs. MSRTC and Anr.in Writ Petition No.9337/2015 and another writ petition No.5632/2015 (Devidas Kashinath Sonawane Vs. MSRTC) this Court, vide judgment and order dated 7.12.2015 and 15.1.2016, had remitted back the matter to the Industrial Court for deciding the Revision Petition afresh.
2) Considering the joint statement made, as BDV
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD above, and the observations of this Court in para 2 of order dated 7.12.2015 in Writ Petition No. 9337/2015, the impugned judgment of the Industrial Court dated 21st July, 2014, is quashed and set aside. The Revision(ULP) No.13/2013 is remitted to the Industrial Court, Dhule, to be decided afresh, considering the acquittal of the petitioner, vide judgment dated 24.1.2013 delivered in Regular Criminal Case No.244/2008. The litigating sides agree to appear before the Industrial Court on 19th July, 2016. Formal notice need not be issued by the Court.
3) The writ petition stands disposed of in the aforesaid terms.
