BHAGWAN SHIKSHAN PRASARAK MANDAL & ORS ...

Advocate for Petitioner : Shri Kedar Balbhim R. AGP for Respondent 5 : Shri Patil K.S.

...

CORAM : RAVINDRA V. GHUGE, J.

Dated: October 16, 2018 ...

PER COURT :- The petitioner is aggrieved by the order dated 22.6.2018 passed by the University and College Tribunal, Aurangabad, by which the application seeking interim relief in Appeal No. BAMU-04/2017 has been rejected.

Learned Advocate for the petitioner has strenuously criticized the impugned order and prays for an interim relief in the nature of reinstatement in service during the pendency of the appeal. It is settled law that interim relief cannot be of the nature of a final relief. If the order of termination / discharge / removal or otherwise termination is under challenge, there cannot be an interim order granting final relief at an interlocutory stage. akl/d
