DATE : JULY 27, 2022 ORDER :- This is an application under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.0296 of 2022 registered with Omerga Police Station, Omerga, Dist.Osmanabad.

Heard learned counsel appearing for the parties. 3.

The FIR has been lodged by the Circle Officer. The facts indicate that there was a dispute over cart-way. The Circle Officer had paid visit to the site for drawing of the panchnama. The applicant is alleged to have obstructed the Circle Officer and a Revenue Official in discharging their official duties. Overt act has been attributed to the

8-BA.937.2022 co-accused, who is not before this Court. Considering the role of the applicant in the alleged offence, he deserves to be granted bail. 4.

Hence, the following order:- (i) The application is allowed.

(ii) The applicant be released in connection with Crime No.0296 of 2022 registered with Omerga Police Station, Omerga, Dist.Osmanabad, on executing P.R. Bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with one surety in the like amount. (iii) The applicant shall not tamper with the prosecution evidence in any manner.
