Heard learned counsel for the applicant and learned APP for the State.

The applicant seeks bail in Crime No.250 of 2023 registered with Majalgaon City Police Station, District Beed for the offence punishable under Sections 302 r/w 34 of the Indian Penal Code.

The FIR reveals that the applicant with other co-accused was going on foot and the main accused was going on the motorbike. The deceased and the main accused slapped each other. The nearby person who was running the shop separated their quarrel but again the main accused smashed a stone on the head of the deceased. The material collected by the investigation officer reveals that the applicant was there. However, he appears not played a role that caused the death of the deceased. Nothing is to be recovered from

Considering the circumstances in which the incident happened and the bare presence of the applicant on the spot of the incident except beating the deceased, nothing is to be recovered from him. The circumstances of the case as discussed above favours the applicant for bail. Hence, the following order :
O R D E R
(i) Bail Application is allowed.
(ii) Applicant, Shrikrishna @ Sonu Raghunath Raut, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount in the above crime, on the conditions that;
(a) The applicant shall not tamper with the prosecution witnesses and shall attend the trial on each and every date.
