The applicant is seeking bail in connection with crime No. I-288 of 2020 registered with Satara police station, District Aurangabad for the offences punishable under Sections 143, 147, 148, 149, 307, 323, 504 of I.P.C. His Criminal bail application bearing No. 1343 of 2020 with similar prayer came to be rejected by the learned Additional Sessions Judge, Aurangabad vide order dated 24.09.2020.

Heard both sides.

Though I find that the name of the applicant is mentioned in the F.I.R. with specific role attributed to him, however, the applicant is in jail in connection with the present crime since 1.9.2020. There are no antecedents as such and as a matter of punishment bail cannot be refused to the applicant when he is having a fixed place of

ba1147.20 -2residence and available for trial. Thus, with certain conditions I am inclined to release the applicant on bail. Hence the following order:-

O R D E R

I.

Application is hereby allowed.

II.

The applicant Devilal Laxman Mungase, in connection with crime No. I-288 of 2020 registered with Satara police station, District Aurangabad for the offences punishable under Sections 143, 147, 148, 149, 307, 323, 504 of I.P.C. be released on bail on furnishing personal bond of Rs.15,000/- with one surety of the like amount on following conditions:- a) The applicant shall not tamper with the prosecution evidence in any manner.

b) The applicant shall attend the concerned police station once in a week i.e. on every Sunday between 8.00 a.m. to 11.00 a.m. till filing of charge sheet.
