Heard learned counsel for the applicant and learned APP for the State.

The applicant seeks bail in Crime No.283 of 2024 registered with Cantonment (Chawani) Police Station, District Aurangabad for the offence punishable under Sections 307, 143, 147, 148, 149, 364 of the Indian Penal Code, Sections 3/25 of the Arms Act, Section 5 of the Medical Termination of Pregnancy Act, and Sections 3(1), 23 and 25 of the Pre-Conception and Pre-Natal Diagnostic Techniques Act, 1994.

The allegations against the applicant were that he came into contact with the victim and her husband for detecting the sex. He took the victim and her husband at places and took money from them. In short, the allegations against him is about cheating. He never took the victim to any of the person who was engaged in illegal
966-ba-1002-2024.odt (2) medical termination of pregnancy. The incident is in two parts. In second part, when actual termination of pregnancy was done, the applicant has no role to play. Considering the allegations of cheating and no involvement in actual termination of pregnancy, the Court is of the view that the applicant deserves bail. Hence, the following order :
O R D E R
(i) Bail Application is allowed.
(ii) Applicant, Dnyaneshwar Prakash Jadhav, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount in the above crime, on the conditions that; (a) The applicant shall not tamper with the prosecution witnesses.
(b) The applicant shall attend the concerned police station as and when called on written notice by the investigation officer till filing the charge sheet.
(c) The applicant shall co-operate with the investigation officer to find out the absconding accused.
