Heard learned Counsel (appointed) for the petitioner and learned APP for the State. Learned APP has tendered across the Bar affidavit-in-reply filed by respondent No.3.
We have carefully perused the application at page 9, which bears date 28th May, 2015. It appears that the said application was filed for extension of parole which was granted on 15th February, 2012 for 30 days. Since the application
817.15crwp filed by the petitioner was not within the period of 30 days for which he was granted parole, question of considering his prayer for extension of parole would not arise. The application dated 28th May, 2015 came to be filed after more than three years for extension of parole when it was granted by order dated 15th February, 2012 for 30 days. The application is misconceived and not maintainable. In that view of the matter, petition stands rejected.
