This is an Appeal filed by the Appellant - Insurance Company under Section 173 of the Motor Vehicles Act, 1988 against the compensation awarded by the Motor Accident Claims Tribunal, Vaijapur, Dist. Aurangabad by the Judgment and Award dated 11.11.2016 in Motor Accident Claim Petition No.13 of 2012 (Old M.A.C.P. No.846/2010).

The learned Advocate for the Appellant - Insurance Company tenders across the table a copy of E-mail from the Insurance Company counter signed by him in respect of the withdrawal of the Appeal.

In view of the above, the following order is passed :
ORDER
[i] The First Appeal stands disposed off as withdrawn. [ii] The amount deposited, if any, in this Court by the Appellant - Insurance Company is allowed to be withdrawn by the Original Claimants as per their entitlement, if not withdrawn. [iii] Award be drawn up accordingly.
