This is an application for grant of regular bail under section 483 Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 in connection with crime No. 369 of 2024 registered with Mukhed police station, District Nanded, for the offences punishable under Sections 420, 406, 465, 467, 468, 471, 473, 294, 507, 201 and 120-B of the I.P.C. (under Sections 318(4), 316(2), 336(2), 337, 338, 336(3), 340(2), 341(2), 296, 351(4), 238(B) and 61(2)(A) of Bharatiya Nyay Sanhita, 2023).

Learned advocate for the applicant pointed out the report, in which it is averred that the applicant has received an amount of Rs.6,00,000/- and therefore, the report is lodged.

Learned advocate for the applicant submitted that after arrest of the applicant, he has paid an amount of Rs.5,00,000/- to the informant. He submitted that considering this aspect as well as the fact that the co-accused in the crime are released on bail by this court and the Sessions Court, the applicant is entitled for bail on the ground of parity. Learned advocate for the applicant therefore, prayed that the application be allowed.

Learned A.P.P. for the respondent-State has strongly opposed the application and submitted that the applicant is involved in serious crime. Considering this aspect, the application be rejected. 5.
Perused the charge sheet, particularly the report and the statements of witnesses. The co-accused in the crime, whose role roles are similarly situated, have been released on bail by this court, as stated above. The applicant's role is similar to that of the other co-accused. The applicant is therefore, entitled for bail on the principle of parity. The application therefore, deserves to be allowed on certain conditions. Hence, the following order.

Application is allowed.

The applicant in connection with crime No. 369 of 2024 registered with Mukhed police station, District Nanded, be released on bail on furnishing personal bond of Rs.50,000/- with one surety of the like amount on following conditions:- a) The applicant shall not tamper with the prosecution evidence and shall not pressurize the witnesses, in any manner.
