Dnyaneshwar Alias Khushal Santosh Patil v. Neha Alias Sangita Dnyaneshwar Alias Khushal Patil
61-wp-7422-22
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO.7422 OF 2022 DNYANESHWAR ALIAS KHUSHAL SANTOSH PATIL
VERSUS
NEHA ALIAS SANGITA DNYANESHWAR ALIAS KHUSHAL PATIL ....
Mr. Vinod P. Patil, Advocate for the Petitioner ....
CORAM : MANGESH S. PATIL, J.
DATE : 18 JULY 2022 PER COURT:- The petitioner is aggrieved by the grant of interim alimony by the court in favour of the respondent @ Rs. 7,500/- per month. 3.
Heard the learned advocate for the petitioner and perused the order passed by the trial court. A copy of the affidavit of the petitioner filed before the trial court was not annexed with the petition. Learned advocate seeks leave to produce it and tenders across the bar which is kept on record.
4.
Needless to state that the Supreme Court in the matter of Rajnieh Vs. Neha ; (2021) 2 SCC 324 has elaborately discussed and issued a direction to the parties to maintenance proceedings, to file elaborate affidavits disclosing everything so as to enable the
61-wp-7422-22 courts to decide the quantum of maintenance. The petitioner in his affidavit did not disclose his occupation and income. The respondent had produced on record the evidence regarding his employment in the pharmaceutical company and also produced his salary slip to disclose his salary around Rs.54,000/- per month. 5.
After taking into consideration his educational qualification, the extant of the agricultural land standing in the name of his father, availability of the irrigation facility and bearing in mind such additional income, the family court has fixed the maintenance @ 7,500/- per month.
6.
In my considered view, the order does not call for any interference in exercise of writ jurisdiction. 7.
The writ petition is dismissed.
