Heard the learned counsel for the applicant and the learned APP for the respondent-State.

The applicant seeks pre-arrest bail in Crime No.216 of 2024, registered with Ausa Police Station, District Latur, for the offences punishable under Sections 304-B, 323, 504, 506 read with Section 34 of the IPC.

The applicant is the mother-in-law of the deceased. The FIR reveals that the deceased was residing at Pune with her husband and her in-laws were residing at Ausa. However, they did not leave the matrimonial life happily. Hence, she went to reside with in-laws. The family members were in touch after discord was settled. On the day of incident, she had vomiting. Hence, her in-laws admitted her to the hospital. Unfortunately,
917-ABA.992-24.odt she died. The marriage was performed in 2018. Since then, there were no reports of ill-treatment were filed. After her death, the report is lodged. However, the allegations appears revolved around the husband. There is no incriminating allegations against the applicant except she did not give understanding to her son not to ill-treat her and maintain her humanly. The weapon has not been used in the crime. The applicant is 60 years old having no antecedents to her discredit. In the circumstances, she deserves anticipatory bail. Hence, the following order :
O R D E R
(i) The application is allowed.
(ii) In the event of arrest, applicant VIJAYABAI W/O SURYABHAN KALE, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety in the like amount on the condition to attend the Police Station as and when called by the Investigating Officer on written notice.
