1) The application is filed by husband for transfer of Marriage Petition No.184/2014 presently pending in the Court of the Civil Judge, Senior Division, Omerga, District Osmanabad to the Court of the Civil Judge, Senior Division, Latur or the Family Court Aurangabad. Heard both sides.
2) In the past, in the year 2014, this Court had made order of transfer of the matter from Aurangabad to Omerga on application filed by the wife. Husband is
2 MCA 126/2016 resident of Aurangabad and at that time wife had contended that she was resident of Omerga. For her convenience the matter was transferred to Omerga. Submission was made for the husband that after getting that order, wife filed one proceeding for maintenance under section 125 of the Criminal Procedure Code in the Latur Court and other proceeding under Protection of Women from Domestic Violence Act in Latur Court. Thus the wife is contending that now she is residing in Latur. Submission was made for the wife that the wife is residing in Latur for the purpose of education of her child. In that case for convenience of both the sides it is desirable that all the matters are brought at one and the same station. 3) In the result, the application is allowed. Marriage Petition No.
184/2014 presently pending in the Court of the Civil Judge, Senior Division, Omerga is withdrawn from that Court and is transferred to the Court of the Civil Judge, Senior Division, Latur. The new Court is to take care and see that the date of the present matter matches with the date given in other two cases which are filed by the wife in Latur Court.
3 MCA 126/2016 new Court on 2nd September 2016. The new Court to expeditiously dispose of the present matter and in any case within the period of four months from the date of receipt of the record from the previous Court. Sd/- (T.V. NALAWADE, J. ) rsl
