Heard learned A.P.P. appearing for the State. Though Respondent is served neither he has caused appearance in person nor engaged any Advocate to represent him.

With the able assistance of learned A.P.P., I have perused the findings recorded by the trial Court in the light of notes of evidence. Prima facie it appears that the conclusions reached by the trial Court in Paras 23 to 25 are not consistent with the evidence brought on record by the prosecution.

In that view of the matter, case is established to allow this Application seeking leave to appeal. Accordingly the Application is allowed and the same stands disposed of.

Action under Section 390 of Cr.P.C. to follow against the Respondent before the Sessions Court, Sangamner.
