Heard the learned Advocate for the parties.

This application is moved seeking transfer of matrimonial proceedings bearing Petition No. A-69 of 2024 pending before the Court of learned Judge, Family Court, Aurangabad to the Court of learned Judge, Family Court, Latur.

It is the case of the applicant-wife that already two proceedings are filed at Latur, one under Domestic Violence Act and another seeking maintenance. The present proceeding sought to be transferred is filed by the respondent-husband for dissolution of marriage. 4.
The learned counsel for the applicant submits that applicant-wife is staying with her old aged parents. There is three years old female child, who is staying with applicant. She has no source of income.

The learned Advocate for the applicant submits that one proceeding is pending at Latur. It is therefore necessary transfer proceeding from Aurangabad to Latur to avoid conflicting judgments. He further submits that travelling to Aurangabad is difficult as there is no one to accompany the applicant-wife. The distance between village Chincholiraowadi to Aurangabad is about 300 kms. She thus prays for transfer of proceedings.

The application is vehemently opposed by the learned Advocate for respondent-husband.

The applicant-wife shall co-operate in speedy disposal of the proceedings without seeking unnecessary adjournments. 8.
Considering the above factors, this Court is inclined to allow the application. Hence following order :
ORDER
(i) The application is allowed in terms of prayer clause "B". (ii) The matrimonial proceeding bearing Petition No. A-69 of 2024 pending before the Court of learned Judge, Family Court, Aurangabad to the Court of learned Judge, Family Court, Latur. (iii) After transfer of proceedings, the applicant-wife shall not seek unnecessary adjournments.
(iv) If the Court finds that, unnecessary adjournments are sought by the applicant-wife, the Court may pass appropriate order compensating the respondent-husband when he personally remains present. (v) The parties to appear before the Court at Latur on 26.03.2025. (vi) The application stands disposed off.
