The petitioner is an educational institute. It preferred a proposal, duly recommended by the concerned University, for permission to establish an Arts, Commerce, and Science College at Mudkhed, Taluka Mudkhed, District Nanded.

The authorities concerned turned down the proposal on the ground that the petitioner did not submit the necessary documents, as they are expected to be submitted in terms of Clause 16 of the

Government Resolution dated 15/09/2017. It is informed by the learned AGP that the spot whereat the petitioner proposed to establish such college is still vacant, meaning thereby, no other educational institute has been given permission to establish a college at that place.

In the aforesaid factual background, we direct the authorities concerned to reconsider the petitioner's proposal, if duly submitted along with all the documents, afresh for the academic year 20262027, on its own merits. The department shall not charge the petitioner any additional fees, meaning thereby, the fees already received shall be given set-off.

The petitioner undertakes to make a fresh proposal within a period of one month from the date of this order. If such proposal is received by the authorities concerned, the same shall be decided on its own merits, in light of the aforesaid observations, within a time frame of six months thereafter.
