By this petition, the petitioner raises a grievance that though, this Court vide order dt. 23.02.2018 directed respondent No. 1 to consider the application of the petitioner for re-recognition afresh considering the inspection report received by it and it was further directed that the decision on the same be taken by the end of May-2018, the respondent failed to take appropriate steps in view of the directions issued by this Court. The Division Bench of this Court was pleased to issue simple notice to respondent no. 1 only on 05.07.2018.

The learned AGP today placed before us a communication dt. 25.09.2018 forwarded by the Dy. Secretary of the State of Maharashtra to the Director of Education (Primary), Maharashtra State, Pune. The learned AGP submits that, though there is some delay, the order of this Court is complied with by a fresh decision on the proposal of the petitioner-Institute. Perusal of the communication shows that, on re-appreciation, the State Government was inclined to grant permission to the petitioner-Institute to run a primary school on self-finance basis. Now, as the decision is taken by the authority and the proposal of the petitioner is decided favourably, the grievance raised by the petitioner stands redressed. We see no reason to keep the petition pending.

The contempt is purged and the petition is accordingly disposed of.
