By order dated 15th December, 2020, this Court has observed that the concerned doctor, who has conducted medical examination of the victim, has noted the tear at 4 O' clock on outer anus ring. It further appears that anal swab is collected for semen detection and C.A. analysis. The Medical Ofcer has even opined that at present fnding/conclusion cannot be drawn. It appears that now the concerned doctor has given fnal opinion after receipt of C.A. report.

In view of the above, learned Counsel for the applicant, seeks leave to withdraw this application with liberty to the applicant to fle an application before the Sessions Court.

The applicant is at liberty to fle an application for bail before the Sessions Court on the ground of change in circumstances, that the concerned Medical Ofcer, who has examined the victim, has given fnal opinion about medical examination after receipt of the C.A. report.
