The Applicant is shown as Accused No. 1 in the First Information Report bearing Crime No. 0089 of 2025 registered with Osmanpura Police Station, District Chhatrapati Sambhajinagar City, for offences punishable under Sections 80, 85, 108 read with 3(5) of the Bharatiya Nyaya Sanhita, 2023. Since the Applicant is apprehending arrest in the above-referred Crime, he has approached this Court by filing the present Application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking Anticipatory Bail. 3.
The aforementioned Crime has been registered on the report lodged by the mother of the Deceased-Shrushti. The Deceased married the Applicant on 08.12.2023. It was a love marriage. After
2 918ABA989.2025.odt marriage, the Deceased was allegedly ill-treated by the Applicant and the in-laws. On 05.05.2025, the Deceased was found hanging in her matrimonial home. She was hospitalised and died on 11.05.2025. Thus, the aforesaid Crime came to be registered. 4.
The papers, particularly the communication dated 11.05.2025 issued by the Policeman at the Police Post of the Police Station Begumpura, Chhatrapati Sambhajinagar, to the Police Inspector of the said Police Station, shows that the Applicant and the mother-inlaw of the Deceased had admitted the Deceased to the hospital. It further reveals that the Deceased was first taken to Oriion CitiCare Hospital, Osmanpura, and was thereafter referred to GHATI Hospital. A copy of provisional Post-mortem Report-cum-Death Certificate shows the opinion as to the cause of death as "Septicemia in an admitted case of hanging". There is no statement of the Deceased after the incident till before her Death. The FIR was not lodged immediately. It came to be lodged after a period of ten [10] days from the date of the incident and four [4] days after her death.
The investigation is almost complete. The report from the concerned Police Station opposing the Bail Application states that, the Applicant will intimidate the witnesses, he will have no fear of law, and he will not attend the concerned Court. These grounds show that, the investigation can be completed without custodial interrogation of the Applicant.

In the backdrop of the above discussion, I am inclined to allow the Application. Hence, the following order is passed:
ORDER
[i] The Application is allowed.
[ii] In the event of arrest of the Applicant, namely, Krushna S/o Shankar Bagul, in connection with Crime No. 0089 of 2025 registered with Osmanpura Police Station, District Chhatrapati Sambhajinagar City, for offences punishable under Sections 80, 85, 108 read with 3(5) of the Bharatiya Nyaya Sanhita, 2023, he be released on bail on his furnishing P.B. of Rs.15,000/- [Rupees Fifteen Thousand], with one surety in the like amount.
[iii] The Applicant shall attend Osmanpura Police Station, District Chhatrapati Sambhajinagar, once in a week, i.e. on every Saturday between 10:00 am to 01:00 pm, till the Charge-sheet is filed. He is further directed to co-operate with the Investigating Agency.
[v] The Application stands disposed off.
