Learned Counsel appearing for the petitioner invites our attention to the order passed by the Secretary, School Education Department, Mantralaya, Mumbai on 03.09.2014. The Secretary, School Education Department, has directed the Deputy Director of Education to conduct inspection in respect of certain requirements supposed to be complied with by the petitionerInstitution and to submit the report to the State Government. Learned Counsel appearing for Respondent-State, on instructions, informs that the Deputy Director of Education has conducted inspection and tendered his report to the State Government for consideration; and decision of the State Government is awaited.

In the facts of the case, we direct the State

{2} wp6297.16.odt Government to take appropriate decision in pursuance to the order dated 03.09.2014, passed by the Secretary, School Education Department, Mantralaya, Mumbai, as well as inspection report tendered by the Deputy Director of Education, Nasik, as expeditiously as possible and preferably within eight weeks from today.

It is also informed by the learned Assistant Government Pleader that provision has already been made for appearance of the students taking education in the petitionerschool for 10th standard (SSC) examination through any recognized school and necessary instructions, in that regard, have been issued to the Education Officer (Secondary), Zilla Parishad, Jalgaon. In this view of the matter, prospectus of the students, taking education in the petitioner-school, shall not adversely affect and appropriate care shall be taken in that regard. In the event of grant of approval by the State Government in favour of petitionerinstitution, it would also be open for the Respondents to permit the students to appear for 10th standard (SSC) examination through the petitioner-school.

In view of above, writ petition stands disposed of with liberty to the petitioner to take appropriate remedial measures and avail of alternate remedy in the event of passing of any adverse decision.
