After having heard the respective Counsel for sometime, it is noted that the petitioner-husband has questioned an order passed by the learned Judge, Family Court in exercise of powers under Section 127 of the Code of Criminal Procedure enhancing the maintenance. The said order came to be passed on 17th November, 2003. The present application is pending since last thirteen years and prima facie it appears that the present applicant is paying the said amount as there was no interim protection granted in his favour.

Looking to the amount of quantum as was ordered by the Magistrate, in my opinion, it is very meager i.e. Rs.400/- to the wife, S.S.DESHPANDE 1 / 2
