We have heard Mr. Salgar, learned counsel along with Mr. Gaware, learned counsel for the petitioner.

The learned A.G.P. points out that the petitioner has remedy under Section 47 of the Maharashtra Regional and Town Planning Act, 1966. 3.

In the light of that, writ petition is disposed of with liberty to the petitioner to avail the alternate remedy. The authority may consider the time spent in prosecuting the present writ petition. All contentions are kept open. No costs.
