1] Heard learned counsel for the applicant and the learned APP for the respondent-State.

2] The applicant is seeking bail as he is arrested on 02.11.2024 in connection with Crime No.I-0348/2024, registered with Jawaharnagar Police Station, Chh. Sambhajinagar, for the offence punishable under Sections 109, 189 (2), 189 (4), 191 (2), 310 (2), 351(2), 351 (3) of the Bharatiya Nyaya Sanhita, Sections 4 and 25 of the Arms Act and Section 135 of the Maharashtra Police Act. 3] It is the case of the prosecution that on 01.11.2024 at about 11.30 hours, while the informant was drinking liquor in a hotel, five accused persons, who were sitting in front of his table came to him. Out of them, one

accused asked informant as to he knows him, he is Tipu. When the informant said that he did not know him, the accused started abusing the informant. Thereafter, the informant came out of the hotel, accused persons came behind him and started beating the informant. The accused no.1 inflicted blow of knife thrice on his head, so also, the present applicant and other accused persons have assaulted the informant.

4] The accused no.1 inflicted blow of knife thrice on the head of the informant has been granted bail by the trial Court by order dated 16.07.2025 in Special Case No.304/2025.

5] The learned APP produced the injury certificate, which shows that there are four injuries and the injuries are simple in nature.

6] Considering that the injuries sustained by the injured being simple in nature and the main accused being granted bail, the applicant is also entitled to grant bail. The application is allowed in the following terms : a] The applicant shall be released on bail in connection with Crime No.I-0348/2024, registered with Jawaharnagar Police Station, Chh.

Sambhajinagar, for the offence punishable under

Sections 109, 189 (2), 189 (4), 191 (2), 310 (2), 351(2), 351 (3) of the Bharatiya Nyaya Sanhita, Sections 4 and 25 of the Arms Act and Section 135 of the Maharashtra Police Act, on furnishing PR bond of Rs.20,000/- with one or two sureties in the like amount to the satisfaction of the trial Court. b] The applicant shall not tamper with the prosecution witnesses.

c] The applicant shall not enter the vicinity where the informant is residing till three months from the date of this order.

7] Needless to say, in case of violation of any of the aforesaid conditions, the bail granted to the applicant shall be liable to be cancelled. It is also clarified that the observations made in this order are limited to the disposal of the present bail application. The concerned Court shall proceed further in the matter without being influenced by the observations made hereinabove.

8] The application stands disposed of.
