Harishchandra Limba Todkar And Others v. The State Of Maharashtra And Others
IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD 915 WRIT PETITION NO. 6539 OF 2015 HARISHCHANDRA LIMBA TODKAR AND OTHERS
VERSUS
THE STATE OF MAHARASHTRA AND OTHERS ...
Advocate for Petitioners : Mr. Chavan Sudhir K. And Salunke S.J.
Mrs. AV Gondhalekar, AGP for Respondents: 1, 3 & 4; Mr. Shelke Shivaji T., Adv. For R/2 __________ CORAM :
R.M.BORDE & P.R.BORA,JJ.
DATE : 7 th JULY, 2015.
PER COURT :
1) Heard. The petitioner has raised objection in respect of inclusion of the names of certain voters in the voters list of an Ward, wherein, in fact, they do not actually reside. The objection to that effect was tendered by the petitioner on 10th June, 2015, which was beyond prescribed date for raising the objection, i.e. 6th June, 2015. So far as the objection raised by the petitioner on 6th June, 2015 is concerned, it is too vague and does not, in fact, import any meaning. Even otherwise, the order issued by the Tahsildar on 11th June, 2015, discloses that there are directions issued by him to the concerned authorities to effect necessary corrections wherever it is noticed that the names of voters are wrongly enlisted in an ward. In view of
the order passed by the Tahsildar on 11th June, 2015, the grievances raised by the petitioner substantially stand redressed. Even otherwise, in view of the constitutional bar provided under Article 243(O), the petition does not deserve consideration. The writ petition stands disposed of.
