Heard learned counsel for the applicant and learned APP for the State.

The applicant seeks bail in Crime No.53 of 2024 registered with Bazarpeth Police Station, District Jalgaon for the offence punishable under Sections 370 r/w 34 of the Indian Penal Code and under Sections 3, 4 and 5 of the Immoral Traffic (Prevention) Act, 1956.

For maintaining the privacy of the women involved in the case, the facts of the case are not reproduced. However, it was the case of the prosecution that the applicant and her husband were running a spa and they were providing sex services to the customers. Few girls were found on the day of the raid. Their statements reveal that they were voluntarily working there. On the day of the raid, money from decoy was received by her husband. Considering the
969-ba-1007-2024.odt (2) facts of the case, the Court is of the view that there is a scope to believe her defence that she had no knowledge of indulging in such profession. The parlour has been shut down. She has two minor children who are residing at the mercy of the relatives. The investigation has been completed. The trial may take its time. She is a woman involved in this crime. On these grounds, she has been granted bail. Hence, the following order :
O R D E R
(i) Bail Application is allowed.
(ii) Applicant, Pallavi Vishal Bharhate, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount in the above crime, on the conditions that; (a) The applicant shall not tamper with the prosecution witnesses and shall attend the trial on each and every date.
