Per Court :- This court while issuing the notices in Criminal Revision Application No.51 Of 2015 observed that, Mr. V.P. Sawant, learned counsel for the Applicant - husband has instructions that the husband would deposit an amount of Rs.150,000/- [ Rs.One Lakh & Fifty Thousand] within a period of THREE weeks from 31st March, 2015 and upon such deposit, the Execution Proceedings were stayed. [2] The husband has honoured his word and has deposited an amount of Rs.150,000/- before this court on 18th April, 2015, is the statement made by Mr. V.P. Sawant, Advocate for the Respondent - husband. Statement is accepted.
2/2 cri.appln. 3379.15 in cra 51.15..sxw [3] Upon such deposit before this court, present Application is filed by the wife, daughter and son who are the Respondents in Criminal Revision Application No.51/15, for withdrawal of amount deposited by the husband.
[4] Heard Mr. J.M. Murkute, learned counsel for the Applicants and Mr. V.P. Sawant, learned counsel for the Respondent - husband.
[5] Mr. V.P. Sawant, learned counsel for the Respondent submitted that he has no objection, if amount deposited is withdrawn by the wife for herself and for minor son and daughter. In that view of the matter, I pass the following order :-
ORDER
(i) Criminal Application No.3379/2015 is allowed. (ii) Applicants will be entitled to withdraw the amount of Rs.150,000/- [ Rs.One Lakh & Fifty Thousand] deposited by the Respondent - ASHOK S/O SUNDARRAO POTE before this court.
(iii) With this Criminal Application is allowed and same is disposed of accordingly.
