Learned counsel for respondent No.1 Mr. Sonpethkar submits on instructions that the suit itself is at substantive part-heardstage. He submits that as the construction permission was under challenge, the Principal District Judge to take steps to see that the matters pending before the Corporation Court and the matters pending before other Courts are brought in one and the same Court and the issue of construction permission shall be considered by the said Court.

In view of this circumstance, matter is disposed of as infructuous.
