The order dated 21st February, 2019 shows that a statement was made on behalf of the Local Body that the construction itself is removed. In view of that statement and as the construction is actually removed, learned counsel for the petitioners, on instructions, submits that the petitioners want to withdraw the proceedings as they may file appropriate proceedings before appropriate forum against the action of removal of the construction. Accordingly, the Writ Petition is disposed of as withdrawn, though learned counsel for the Local Body submits that the suit filed in the past by the petitioners is already disposed of.
