DATE : 13TH JULY, 2023 ORDER :- Mr. Patil, learned advocate for the applicant submits that the appellant Acquiring Body has already accepted a similar award and no appeals are filed. He placed reliance on the communication dated 6.5.2020 issued by the Deputy Divisional Officer of the appellants. He would further submit that in some matters arising out of the same award, 75% of the amount is permitted to be withdrawn. Mr. Bhalerao learned counsel for the Acquiring Body does not dispute this position.

Considering the submissions advance, the application is allowed. The applicant is permitted to withdraw 75% of the amount deposited by the appellant/acquiring body upon undertaking to be furnished before the Registrar (Judicial) of this court. Civil application is disposed of.
