The petitioner is challenging the order dated 03/11/2018, passed by the learned Judicial Magistrate First Class, Aurangabad in S.C.C. No.3000/2018. Vide the said order, learned Judicial Magistrate First Class, Aurangabad rejected the application filed by petitioner under Section 311 of the Code of Criminal Procedure for recalling the complainant for further cross-examination.

This petition is pending before this Court since 2019 and the same was never circulated or listed before this Court in these six years. Learned Advocate for the petitioner is absent. 3.

In view of the above, since the order dated 03/11/2018 pertains to the recalling of the complainant for further crossexamination, the Trial Court may have already proceeded with the
