The learned Counsel for the petitioners submits that respondents have complied the work of the road without any notice to the petitioners.

In light of that, the relief that would be claimed by the petitioners would be different. The present petitioners were seeking restraint upon the respondents from constructing the road. 3.
As the road is already constructed, the purpose of the writ petition would not serve.
