Narsingh Vishwasrao Nayak v. The State Of Maharashtra And Others
( 1 ) 24 wp 7280.19
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 24 WRIT PETITION NO.7280 OF 2019 NARSINGH VISHWASRAO NAYAK
VERSUS
THE STATE OF MAHARASHTRA AND OTHERS ...
Advocate for Petitioner : Mr. Barlota Ambar S. AGP for Respondents/State : Mr. A.R. Kale ...
CORAM : SMT. VIBHA KANKANWADI & Y.G. KHOBRAGADE, JJ.
DATE : 9th November, 2022 P.C. :- Heard. Learned AGP has raised strong objections. 2.
After hearing it can be seen that the prayer clause-B states about order dated 21.12.2018, however, the (Exhibit-F) dated 21.12.2018 is in fact the communication by respondent no.3 to Secretary and Deputy Chief Election Officer, Maharashtra State, Mumbai and it cannot be considered as order. When the communication cannot be considered as order at all, there is no question of setting it aside. It also appears that the grievance of the petitioner about his voting rights have become infructuous on the point that the elections have already been held. There is nothing in the petition and it deserves to be dismissed. Accordingly, the writ petition is dismissed. [Y.G. KHOBRAGADE, J.] [SMT. VIBHA KANKANWADI, J.] mub
