The applicant has taken up this application under Section 394 of Cr.P.C. seeking leave to continue appeal No.335 of 2004 which was filed by her husband i.e. appellant No.2 for the reasons set out in the application.

Heard learned counsel for the applicant and APP for the State.

The accuse No.2 Gangadhar Dhere (Appellant No.2) the deceased husband of the applicant was held guilty of offence u/s 7 of the Prevention of Corruption Act, 1988 and sentenced to suffer R.I. for two years and to pay fine of Rs.1000/- I.D. R.I. for three years. The accused

( 2 ) criapln3168.16 No.1 (Appellant No.1) held guilty of offence under Section 13(1)(d) r/w 13(2) of the Prevention of Corruption Act, 1988 and sentenced to suffer R.I. for two years and to pay fine of Rs.700/- I.D. R.I. for two months. Being aggrieved both the accuse have prepared appeal. The appellant No.2 reported to be died on 13.04.2016.

Upon considering the submissions advanced and the cause assigned the application is allowed in terms of prayer clause-B. Necessary substitution be made in the memo of appeal by red-ink.
