In view of this circumstance, the learned counsel seeks liberty to withdraw this application.

Liberty as prayed for is granted in the interest of justice, with further liberty to approach the Sessions Court under Section 439 of the Code of Criminal Procedure as there is change in the circumstance. The learned Sessions Court shall not be influenced by the withdrawal of this application.
