After hearing the learned counsel for the petitioner, he came around to submit that, his case be relegated back to Respondent No.2/ District Collector, Nanded before whom he put-forth his case for refund of earnest money.

In view of the same, the Writ Petition stands disposed of in terms of following order :

ORDER

(i) The impugned order dated 17.06.2021 forfeiting amount of Rs.64,13,274/- is hereby set aside.

(ii) Respondent No.2/ District Collector, Nanded shall hear the petitioner and then pass an appropriate order regarding forfeiture of the earnest money on its own merits and uninfluenced by this order. (SANDIPKUMAR C. MORE) (R. G. AVACHAT ) JUDGE JUDGE
