Learned counsel appearing on behalf of the parties submit that in view of amendment in Bombay City Civil Court's Act, 1869 by the Bombay City Civil Court's (Amendment) Act, 2015, dated 29-07-2015 and the circular No. Rule P-3601/2015 dated 01-09-2015 issued by the Registrar (Judicial-I) High Court at Bombay as regards enhancement of pecuniary jurisdiction of the District Court upto rupees one crore, the present first appeal is required to be transferred to the concerned District Court for its adjudication on merits. 3.

In view of the aforesaid development in regard to enhancement of pecuniary jurisdiction of District Court, there is no impediment to transfer the present first appeal for it's adjudication on merit to the concerned District Court.

Registry to take requisite steps for transfer of first appeal for adjudication on merits to the concerned District Court. The record and proceedings of the matter as well as if any deposit of decreetal amount into the matter, are also required to be remitted back to the concerned District Courts to facilitate it for proper adjudication of appeal on merit.
