Heard learned Advocate for applicant and learned APP for Respondent No.3. From the submissions those have been made, it appears that the applicant mainly wants to contend that there is breach of terms of condition Nos.4 and 5 and according to the applicant, it has been breached. Under such circumstance, when the bail was granted by learned Additional Sessions Judge, the applicant should approach the concerned Court first. The learned Advocate for applicant, therefore, prays for withdrawal of the application with liberty to approach the concerned Court. Accordingly, the application stands disposed of as withdrawn with liberty as prayed for.
