08.08.2019 P.C. :- Heard Mr. Gunale the learned advocate for the petitioner and Mr. Bondar for the respondent no.2. None appears for respondent nos.3 and 4. 2.

The learned advocate for the petitioner submits that the father of the petitioner Sangram died on 11.05.2003 while in service with respondent no.4-school. The entire family of the petitioner was dependent on the father as he was the only earning member and source of income. The petitioner was minor at the time of death of this father. The petitioner has passed H.S.C. in the year 2006, thereafter he has completed B.Ed and has also completed D.Ed. The learned counsel submits that on 22.12.2013 the petitioner submitted an

( 2 ) 3 wp 6144.14 application for seeking appointment on compassionate ground. The Headmaster represented that no post is available. The learned counsel submits that one post of Assistant Teacher is vacant with the respondentschool. The petitioner is entitled for appointment on compassionate ground. 3.

Mr. Bondar the learned counsel submits that the petitioner did not apply within time.

The purpose of giving appointment on compassionate ground is to provide immediate succor to the family of the deceased. The father of the petitioner died in the year 2003. The petitioner applied for appointment on compassionate ground six years after he attained the age of majority and eleven years after the date of death of the father of the petitioner. As on today sixteen years have lapsed since the death of the father of the petitioner. 5.

Considering all the aforesaid aspects the request of the petitioner cannot be accepted. Writ petition is disposed of. No costs. [MANGESH S. PATIL, J.] [S.V. GANGAPURWALA, J.] mub
