The Applicant submits that owing to his termination in 1996, he had moved Appeal No.210/1996. The said appeal was compromised between the Applicant/ Employee and the Management and the appeal was withdrawn. Since the Management allegedly resiled from the compromise, he moved an application for restoration of the said appeal. The application praying for restoration of the appeal was allowed by the impugned order dated 03.09.2004 and Appeal No.210/1996 was restored to the file.

*2* 32.ca.7082.15 By this writ petition, the Management has challenged the said order of the School Tribunal which has been stayed and as a consequence, the appeal filed by the Applicant/ Employee is not progressing. Learned Advocate for the Respondent/ Management has fairly submitted that this petition involves a short issue and can be decided expeditiously.

In the light of the above, this Civil Application is allowed. Writ Petition No.5918/2004 be listed for final hearing on 23.07.2015. (RAVINDRA V. GHUGE, J.)
