Mr. Karad, the learned counsel for respondent Nos. 1 and 2 raises preliminary objection that the petitioner has alternate efficacious remedy under Section 451 of Maharashtra Provincial Municipal Corporation Act. In the light of that, though Mr. Killarikar, learned counsel for the petitioner sought to canvass the submissions on merits, we are not inclined to consider the same. Writ petition is disposed of with liberty to the petitioner to avail alternate remedy. All contentions are kept open. 2.
In case such proceedings are filed by the petitioner, then the authority where the said proceedings would be filed shall endeavour to decide the same expeditiously, preferably within four months on receipt of the said proceeding.
