The original claimant, who is respondent in the Appeal, has preferred this application for withdrawal of the 50% amount remaining with this Court out of the entire amount deposited by the acquiring body. 2.

Learned counsel for the applicant submits that the acquiring body has deposited entire amount under award and the applicant had withdrawn 50% amount out of the said amount deposited by the acquiring body. Learned counsel for the applicant further submits that, applicant is old aged and he has recently lost his mother.

Considering such exigency, case is made out for withdrawal of further 25% amount. The applicant herein is allowed to withdraw 25% amount out of the entire amount deposited by the acquiring body along with accrued interest thereon on furnishing usual undertaking to the satisfaction of the learned Registrar (Judicial) of this Court. 4.

Application stands disposed off accordingly.
