Misc. Civil Application No. 127/2025 is filed by the wife seeking transfer of the proceeding of Petition A No. 1116/2024 from the Court of learned Judge, Family Court, Pune to the Court of learned Judge, Family Court, Latur. Misc. Civil Application No. 178/2024 is filed by the husband seeking transfer of proceeding of H.M.P. No. 1350/2019 from the Court of learned Judge, Family Court, Latur to the Court of learned Judge, Family Court, Pune. Misc. Civil Application No. 177/2024 is filed for transfer of Petition E No. 233/2021 pending before the Court of learned Judge, Family Court, Latur to the Court of learned Judge, Family Court, Pune.

The wife is seeking transfer of the proceedings filed by the husband in the Court at Pune on the ground that, distance is about 350 kms. between two places. A daughter of eight years of age is residing with wife. She find it difficult to travel to Pune

The application is vehemently opposed by the learned advocate for husband. She submits that, at Latur there is danger to the life of the husband. He was given threat by brother of wife of dire consequences, who is no more. Therefore, the husband has apprehension and find it difficult to travel to Latur. 5.
The husband initially has filed the proceeding for restitution of conjugal rights. On finding that, there is no possibility, he lateron he filed the proceeding for divorce. The wife has filed proceeding under section 125 for maintenance. 6.
This Court finds that, the wife is residing with her eight years daughter at Latur. Therefore, in the present matter, convenience of the wife needs to be seen. Hence, following order :
ORDER
(I) Misc. Civil Application No. 127/2025 stands allowed in terms of prayer clause (B).
(II) After transfer of the proceeding, the wife shall not seek

If she seeks unnecessary adjournments, the Court may pass appropriate order compensating the husband if he remains present. (III) As far as possible, the husband be allowed to appear through video conferencing facility.
(IV) Misc. Civil Application No. 177/2024 and Misc. Civil Application No. 178/2024 stand dismissed.
(V) As far as possible the proceeding be decided preferably within one year from today.
