The petitioners are in the additional wait list. The petitioners had applied for the post of Assistant Junior. They participated in the selection process. Their names were entered in the additional wait list. The wait list was prepared in 2016-2017.

An issue arose in August, 2019 as to what is to be done about the select list as well the wait list, and whether an extension should be granted. By circular dated 27-08-2019, the General Manager (Personnel and Industrial

936-WP-8026-21 Relations) has observed in paragraph No. 3, insofar as the extension to be granted to the select list, that the select list is granted extension, till the last selected candidate is appointed. This has been a decision of the Board of Directors of the Corporation.

The learned Advocate representing respondentMSRTC places before us a further communication by the General Manager (Personnel and Industrial Relations) addressed to all Depot Manager/s, dated 03-07-2021 stating that as there are enough candidates available in the select list, there is no scope for absorbing any candidate from the wait list, and hence, absorption from the wait list is declined by the Board. The said communication is taken on record and marked as "X-1" for identification.

In view of the above, this petition praying for a direction that these petitioners from the additional wait list should be granted appointment orders, is without merit. The same, is therefore, dismissed.
