This matter was not on Board. A motion was moved at 10.30 am today, that the petitioner / husband desires to withdraw this petition. Hence, taken on the Production Board. 2.

This Court had passed an order on 17.7.2019 recording that the petitioner is in arrears of Rs.91,000/- towards maintenance to be paid to the respondent / wife. The petitioner, subsequently, moved an application before the learned Family Court stating that he desires to withdraw Case No.56 of 2018 on the ground that he would allow the wife to live with him as husband and wife. The wife had filed a reply to the purshis contending that the husband wants to harass her. She was ready to cohabit with the petitioner subject to costs of Rs.30,000/- for withdrawing the proceedings.

Today, the learned Advocate for the wife submits that she would prosecute the execution proceedings for recovery of arrears of maintenance. The learned Advocate for the husband submits that this petition be disposed off as withdrawn and the execution proceedings can be taken to a logical end.

In view of the above statements having been recorded, this petition is disposed off as withdrawn and all contentions of the wife are kept open if the husband initiates any proceeding in future for separation / divorce.
