Heard learned counsel for respective parties. 2.

By way of present petition, the petitioner assails the order dated 17.03.2023 passed by the District Superintendent of Land Records, Aurangabad in Appeal No.2771/2022 whereby the application for condonation of delay filed by respondent nos.5 to 7 came to be allowed.

After going through the order passed by respondent no.2/DSLR, though the application was filed for seeking condonation of delay but only on roznama, the order came to be passed and no any reasons are recorded by the authority while allowing the application for delay condonation. In view thereof, I am inclined to allow the writ petition by setting aside the order passed by respondent no.2/DSLR dated 17.03.2023.

In view of the above, the petition is allowed. The order dated 17.03.2023 passed by the respondent no.2/District Superintendent of Land Records, Aurangabad in Appeal No.2771/2022 is quashed and set aside. The application filed for condonation of delay is restored.

The respondent no.2 is hereby directed to decide the said application afresh by granting an opportunity of hearing to all the concerned. The respondent no.2/DSLR is directed to decide the application for condonation of delay within a period of two months from today. The parties to appear before respondent no.2/DSLR on 05.01.2026.
