PER COURT :- There is no dispute in respect of the fact that the petitioner has deposited total amount of Rs.41,27,500/-as an earnest money/ security deposit on 5.1.2014 and that due to intervention by this Court in Writ Petition No.1325/2014 and subsequent proceedings initiated before the Secretary, Revenue & Forest Department, the petitioner could not get the possession of the sand spot during the year 2012-2013. The petitioner is thus entitled to receive back the amount deposited with the respondent. We direct the respondents to refund the amount deposited by the petitioner, as expeditiously as possible and preferably within a period of 8 weeks from today. The writ petition is disposed of.
