Heard the learned counsel for the applicant and the learned APP for respondent/State.

The incident allegedly happened on 19.04.2022. In a police raid, 1 Kg. 660 Gram Ganja was found in the house of applicant over which she has conscious possession. The necessary procedure after the raid has been done by the Investigating Officer. The applicant is around 70 years old having numerous physical ailments. The police also has conceded this fact. In view of physical ailments, the police also are not able to arrest the applicant.

In such circumstances, no blanket protection from arrest can be granted. The Investigating Officer may require the custody of the applicant in time. Therefore, this is a fit case to pass following order - i) In the event of arrest, the Investigating Officer shall serve 72 hours' notice upon the applicant before her arrest. 4.
