IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.6634 OF 2015 Datta s/o Sandipan Netke Petitioner

Versus

The State of Maharashtra & others Respondents Mr.V.B.Deshmukh, advocate for the petitioner Mr.N.B.Patil, A.G.P. for Respondents No.1, 3 & 4. Mr.S.T.Shelke, advocate for Respondent No.2.

CORAM : R.M.BORDE & P.R.BORA, JJ.

DATE : 15th July, 2015 PER COURT:

The petitioner is objecting to the enlistment of names of voters in two constituencies, which, according to the petitioner, is prohibited under the provisions of Representation of the People Act. Since the programme of elections of Village Panchayats has been declared and the stage of acceptance of nomination papers has reached, no interference need be caused at an advance stage of election process.

It would be open for the petitioner to pursue his claim with the District Election Officer and it would be open for the District Election Officer to take coercive measures during forthcoming review of Assembly Election Rolls.. Writ Petition is devoid of substance. Writ Petition stands dismissed.
