The learned advocate for the applicant produced on record order dated 2.2.2024 passed in CA No. 10743/2023 along with other connected applications. She further points out the order of the same date passed in Civil Application No. 12437/2023 along with other connected applications and submits that in both the orders this Court has permitted the applicants therein to withdraw 75% of the amount along with interest on furnishing usual undertaking. She submits that these orders are passed in the matters arising out of the same acquisition, for the same project. There is no dispute about the same. In view of the above, following order.

ORDER

(i) Civil Application stands allowed. Applicants are permitted to withdraw 75% of the amount deposited by the appellant in this Court along with accrued interest on furnishing usual undertaking. Remaining amount be invested in fixed deposit in any nationalized bank till the disposal of the appeal. With this the application stands disposed of. ( KISHORE C. SANT, J. ) ssc/
