Rule, returnable forthwith. By consent of the parties, taken up for final hearing.

This petition has been filed seeking directions to the respondent No.2 to transfer petitioner at a Primary School run by it, which is close and near to Parbhani town, considering the representations made by the petitioner dated 8.1.2015 and 3.6.2015.

In pursuance to the notices issued to the respondents, learned Counsel for the respondent

6614.15wp No.2 submits that, representations of the petitioner have been decided and the same came to be rejected. In response to a query of this of this Court as to whether there are any vacancies in the schools nearby Parbhani town, the learned Counsel for respondent No.2, on instructions submitted that, there are vacancies in eight schools.

In the light of said position of vacancies, the learned Counsel for the petitioner submits that, if the petitioner is transferred in the Primary School Satala or Karla or at Murumba, the petitioner's grievance will be satisfied.

In that view of the matter, since the petitioner's wife is suffering from cancer, in the peculiar facts and circumstances of this case, we direct the respondent No.2 to transfer the petitioner at Primary School, Satala or Karla or Murumba, as expeditiously as possible; however, within a period of four weeks from today.

Rule is made absolute in above terms.
