Heard learned counsel for the applicant and the learned counsel for respondent no.1/original petitioner. 2.

It appears that the petition has been filed only for noncompliance of form no. 26 which is part of the nomination form. It is submitted that non-compliance of the same would amount to disqualification incurred by respondent no.1. In view of the same, there is no reason to keep the EVM machine in the strong room as it is till disposal of the election petition.
